They’re hung. By way of a note, any hope the jury has made progress in the last three days was dashed. The note said “We regret to inform the court that after many days of deliberating, we were unable to reach a verdict of either guilty or not guilty on any/all of the counts.”

Whereas it is midnight in the Scrushy trial, perhaps a quarter to twelve in the Enron situation, maybe a bleak day-after for WorldCom, it is just barely dawn in the analysis of what this has all meant, and where it is going. While we wait for the verdict and do crosswords in the jury assembly room and rehash old testimony, the HealthSouth story is still as big and as ongoing as it has ever been, there are still many answers to be found in the bombed out landscape of corporate America. WorldCom. Tyco. Enron. And yes, HealthSouth. And there are the large peripheral support companies: The weakened Ernst & Young and the destroyed Arthur Anderson.

[I apologize for the hiatus I took, with regards to not posting an entry for the last few days. After fifty-four days in a courtroom, I needed to catch my breath (like so many others). I was not completely dormant as I worked on the previously promised article about Mr. Scrushy’s dilemma, and I managed to get a couple of interviews done.
